How We Obtain Consent
Consent is obtained verbally during a phone call, in-person meeting, or virtual appointment. Implied consent applies only when a customer initiates contact by texting Deep Dive Taxes, Inc. first using a publicly listed phone number designated for customer communication. In these cases, we may send an initial acknowledgment message solely for the purpose of facilitating the double opt-in process. No service-related replies will be sent until the customer confirms their consent through the required double opt-in, as outlined in the Implied Consent for SMS Communications section.
Verbal Consent Script:
“To help us stay in touch regarding your tax and accounting services, Deep Dive Taxes, Inc. may send you service-related text messages such as appointment reminders, document requests, secure portal instructions, filing updates, and support messages.
We do not send marketing or promotional texts, and we do not share your phone number with third parties. Message and data rates may apply. You can reply STOP at any time to opt out, or HELP for assistance.
Do we have your permission to send text messages to this phone number?”
Once the client says “Yes”, we document consent with:
Implied Consent for SMS Communications
Deep Dive Taxes, Inc. may rely on implied consent to send SMS messages only when a customer directly initiates contact by texting the company using a phone number that is publicly listed for customer communication. This type of consent applies only to non-marketing, service-related interactions.
To meet carrier requirements, double opt-in will be enabled for all interactions initiated under implied consent. After the customer’s initial inbound text, Deep Dive Taxes, Inc. will send a single confirmation message requesting that the customer reply “YES” to verify their consent to continue receiving SMS communications. Additional messages will be sent only after the customer provides this explicit confirmation.
The initial acknowledgment message sent before the double opt-in confirmation will be limited to confirming receipt of the customer’s message and requesting opt-in verification. It will not include any marketing, promotional, or recurring messaging. If the customer does not provide the required confirmation, no further SMS communication will be sent.
Implied consent applies only in the following situation:
• The customer texts Deep Dive Taxes, Inc. first, using a publicly listed phone number designated for customer communication.
Under implied consent and after receiving the customer’s double opt-in confirmation, Deep Dive Taxes, Inc. may send messages limited to:
• Responses to the customer’s inbound request
• Information directly related to the inquiry they initiated
• Single-session, conversational messaging that does not continue beyond the customer’s engagement
Implied consent does not permit marketing, promotional, or recurring automated SMS messages. Recurring updates, reminders, or program-based messages require a separate and explicit verbal opt-in from the customer.
Consent is documented in the TaxDome client profile notes to ensure secure retention and audit traceability.
Message frequency varies by client need, typically 1 to 5 messages per week. All messages are sent from registered business numbers associated with Deep Dive Taxes and clearly identify the company. Each message includes opt-out instructions.
Standard SMS footer used in messages
“Msg and data rates may apply. Reply STOP to opt out, HELP for help.”
Carriers are not liable for delayed or undelivered messages. Message delivery may be affected by your carrier or wireless service.
We retain SMS consent, opt-in, and opt-out records for the duration of the client relationship and for at least four years after the last SMS message or as required for legal or regulatory audits. Records are stored in TaxDome.
